A data subject access report acc. to Article 15 GDPR includes all the information we hold about you and is only for your personal information.

The InfoPass provides data essential for the designated recipient (authority, landlord, employer, or bank/financial service provider): 

  • The InfoPass for financers and InfoPass for authorities specifically includes information about loans and lease contracts, etc.
  • The InfoPass for applicants and the InfoPass for tenants, for example, provides a summary report on any negative entries that may have been made. A negative entry is made when the due date for repayment of a loan has been accelerated or when invoices have been turned in for debt recovery. Details about loans or specific payment issues are not included. 

The data subject access report acc. to Article 15 GDPR includes all the information about you that KSV1870 has stored in its records.

We do not indicate any validity period because data can change daily. For that reason, the access report only indicates the date of issue. As a general rule, the following applies: the more recent, the better. Please also make sure to ask the recipient of the access report or the InfoPass how current the statement needs to be.

  • An InfoPass for tenants, applicants, financers: 3 working days
  • A data subject access report acc. to Article 15 GDPR: within the statutory period of one month

Each InfoPass for authorities, tenants, or applicants costs EUR 43.00. The InfoPass for financers costs EUR 53.00. The data subject access report acc. to Article 15 GDPR is free of charge.

KSV records statement (InfoPass): Content

A data subject access report contains all the information we hold about you. Such data can include: 

  • Name, date of birth, address/addresses
  • Insolvency, debt recoveries
  • Loans and lease contracts, credit information like payment issues (such as accelerations of due date) and behaviour in breach of contract (such as credit card misuse)
  • Credit standing (KSV1870 RiskIndicator)
  • Commercial functions (current and former)
  • Equity interests held, land register, compliance information

The KSV records statement provides the data current as at the date of issue. Please make sure to ask the recipient of the access report how current the statement needs to be.

Yes, an InfoPass for financers and InfoPass for authorities includes all your loans. 

An InfoPass for applicants and InfoPass for tenants provides a summary report on any negative entries that have been made. KSV entry / changing data

KSV1870 mainly keeps records of all your current credit relationships and your payment history to date. Please note: Most of the information is positive. Approximately half of Austria's adult population have an entry because they have taken out a loan. If the instalments are always paid on time, that is positive information. This is different in case of payment issues or an insolvency.

For our credit reports, we process the following personal data: 

  • Name
  • Date of birth
  • Address (street, street number, postcode, city/town)
  • Former names
  • Former addresses
  • Business responsibilities such as commercial positions
  • Equity interests held
  • General information from the company register and/or the land register
  • Insolvency information
  • Payment records

Other information related to credit rating that is publicly accessible or that you have provided us with.

An entry is made in the following cases

  • When an overdraft facility is granted: amount and period
  • When a loan is taken out: maturity or whether instalments are being paid on time
  • When an instalment loan is taken out (e.g. car lease, instalment loans in home centres or at electronics retailers, etc.)
  • In the event of credit requests
  • Accelerated credit lines (current accounts)
  • Acceleration of credit card invoices or credit instalments
  • Debt recovery reminders
  • Personal insolvency or insolvency proceedings
  • Forced sales/attachments
  • Misuse of ATM cards or credit cards

To protect consumers from becoming over-indebted and companies from payment defaults.

That varies. The period of retention depends on the type of entry made (from 90 days to 7 years). As a general rule, the following applies: the more serious the payment issue, the longer the retention period. The retention period is longest for insolvencies because they are the most serious kind of payment default.

Your data can be disclosed to recipients – but only if they have a predominantly legitimate interest. That is usually the case when the payment default risk needs to be assessed prior to closing a deal or entering into a contract (creditor protection). KSV1870 maintains the Business Database, ConsumerCreditRecords, and the Austrian bank warning list. There are strict rules that specify which companies or organisations are allowed to retrieve information from which database.

Yes, insolvencies are recorded by KSV1870.

The Business Database contains information about 640,000 businesses and 7.5 million personal data records in Austria. 

Generally, businesses and private individuals can access information if they have a legitimate interest. That is usually the case when the payment default risk needs to be assessed prior to closing a deal or entering into a contract (creditor protection).

The ConsumerCreditRecords comprises over four million consumer credit relationships. Only banks, lending insurance companies, and leasing companies headquartered in the European single market can log in and request information. The purpose is to protect the lending industry from financial losses and to ensure that private individuals do not take out loans from different institutions in such a way that they end up unable to repay the debt because the sum total of their debt exceeds their ability to repay. 

The Austrian bank warning list includes credit information about private individuals, particularly payment issues and behaviour in breach of contract. Only banks have access to this database.

Credit standing

Credit standing describes the probability that a private individual or company will likely fulfil their financial obligations under an agreement – for example, under credit contracts or from a sale on open account.

In addition to the KSV1870 Group, there are a number of other credit reference agencies that keep credit information on private individuals or companies. Anyone seeking information on their credit standing would be well advised to order a data subject access report in acc. to Article 15 GDPR from all of these service providers.

There are several accepted methods to determine credit standing. Credit standing can vary between credit reference agencies as every credit reference agency has access to different data and uses their own scoring or rating model to weight the data.

Credit standing is important if you are looking to take out a loan, for example, or to enter into a lease contract or to apply for some other kind of financing, or when you are buying a product. A company will enter into a contract with you only if you have the required good credit standing.

Please note: Each company decides for itself how to deal with a person's credit standing. KSV1870 provides the necessary data. 

If you have poor credit standing, your request for financing may be denied. Power utilities or mobile phone operators may also turn you down. And you may not be given the option of making online purchases on account. Poor credit standing may also lead to higher lending rates. Why is that? Because the default risk is higher than with good credit standing. The companies/banks may "price in" the elevated risk.

Banks and companies are obliged to check the credit standing of anyone they enter into a contract with. This is known as commercial due diligence.

There are laws that specify who is allowed to obtain which information – access is always subject to what is termed a legitimate interest. When a company intends to do business with a private individual or a business, for example, it has a legitimate interest.

KSV1870 offers a number of different access reports that are issued for specific purposes, including for submission to an authority or for presentation to a landlord. These access reports only include the data needed for the specific purpose at hand.

  • Consistently avoid any payment issues. 
  • Always try to pay invoices on time, even small amounts!
  • Proactively find a quick solution when facing debt recovery actions (e.g. payment in instalments)
  • Agree to pay for consumer goods in instalments only if you can really afford to.
  • Make sure to pay your loan instalments on time. 
  • Remember, delays in payment can lead to a KSV1870 entry. If you are having difficulties, make sure to proactively contact your bank quickly.
